Program Summary: 

With recent statewide legislation of medical marijuana, understanding the law is paramount to avoiding litigation. The presentation will provide advice and reassurance to employers wondering how to deal with potential employees who will use marijuana for a medical reason. We will discuss changes to drug testing, pre-hire screening, and post-accident testing for employers.

Additionally we will review common issues in drug and alcohol litigation, as well as summarize the current federal and state laws governing an employer’s right to restrict drug use.

Finally, we will provide practical advice about when and how to test for alcohol and drugs, and the elements of a good substance abuse policy.

Learning Objectives:

  1. Understand what North Dakota and Minnesota laws say about drugs in the workplace.
  2. Learn how to handle situations where employees may use marijuana for a medical reason.
  3. Acquire knowledge about how and when to test employees for alcohol and drugs.
  4. Increase awareness about the common issues in drug and alcohol litigation.

About the Speaker: 

Cynthia Bremer is the managing shareholder of the Minneapolis office of Ogletree Deakins. Cynthia has extensive experience in employment law and complex litigation matters. In addition to practicing in Minnesota, Cynthia has also practiced law in North Dakota and continues to practice law there today.

Stephanie Willing is an associate attorney in the Minneapolis office of Ogletree Deakins. Stephanie represents employers in all aspects of employment-related litigation in state and federal court and before the Equal Employment Opportunity Commission and analogous state agencies.
